Updates to these Terms may be posted through BrickHosting.org, the billing portal, Discord announcements, or customer notices.


1. Overview

These Terms of Service (“Terms”) govern access to and use of services provided by BrickHosting.org (“BrickHosting,” “we,” “us,” or “our”).

By creating an account, purchasing a service, adding account balance, deploying a workload, accessing a panel, using support, or using any BrickHosting infrastructure, you agree to these Terms.

If you do not agree to these Terms, you must stop using BrickHosting services immediately.


2. Eligibility

To use BrickHosting services, you must:

  • Be at least 13 years old
  • Have permission from a parent or legal guardian if under 18
  • Provide accurate account, billing, and contact information
  • Be legally allowed to use online hosting services
  • Comply with all applicable laws and platform rules

BrickHosting may refuse service, suspend accounts, or terminate services if:

  • Account information is false or misleading
  • The account is used to evade a prior ban
  • The user creates multiple accounts to bypass restrictions
  • The user creates risk to BrickHosting, customers, providers, or third parties

Previously banned users may not return without written permission from BrickHosting.


3. Services Provided

BrickHosting provides infrastructure, hosting, runtime, and related technical services.

Services may include:

  • Application hosting
  • Game server hosting
  • FiveM-compatible hosting
  • Voice server hosting
  • Discord bot hosting
  • Platform bot hosting
  • Code runtimes
  • Database hosting
  • Containerized workloads
  • VPN hosting
  • Compute, storage, and networking
  • Developer infrastructure
  • Managed or semi-managed hosting services
  • Related support services

Services may run on shared, dedicated, virtualized, or containerized infrastructure.

Performance may vary based on system load, upstream providers, network conditions, hardware limits, customer workload behavior, and abuse prevention systems.

BrickHosting may modify, restrict, suspend, migrate, throttle, isolate, or terminate services when needed for stability, security, abuse prevention, maintenance, legal compliance, or platform protection.


4. Independent Provider and Third-Party Disclaimer

BrickHosting.org is an independent hosting provider.

BrickHosting.org is not approved, sponsored, endorsed, certified, affiliated with, operated by, or officially associated with any third-party platform, company, software project, framework, game publisher, payment processor, or service provider referenced by BrickHosting.

References to Rockstar Games, Take-Two Interactive, FiveM, Cfx.re, RedM, Discord, GitHub, Pterodactyl, Paymenter, PayMenter, PayPal, Stripe, Cloudflare, NGINX, MariaDB, MySQL, Node.js, Python, JavaScript, PHP, Laravel, Docker, Ubuntu, Linux, or any other third-party names, trademarks, software, tools, programming languages, platforms, frameworks, or services are used only to describe compatibility, supported environments, integrations, technical requirements, or customer use cases.

All trademarks, service marks, logos, software names, product names, framework names, and programming language names remain the property of their respective owners.

Use of any third-party name does not imply endorsement, sponsorship, certification, partnership, approval, authorization, or affiliation.

BrickHosting does not grant customers any license, permission, ownership right, or legal authority to use third-party software, trademarks, copyrighted content, APIs, game assets, mods, scripts, platforms, payment services, or services.

Customers are solely responsible for obtaining and maintaining any licenses, accounts, keys, subscriptions, approvals, rights, or permissions required for their use of third-party services or software.


5. Account Responsibility

You are responsible for all activity under your account.

You are responsible for:

  • Account security
  • Password and credential protection
  • API tokens and access keys
  • Billing activity
  • Deployed applications
  • Hosted content
  • Stored data
  • Server configurations
  • User access granted by you
  • Compliance with these Terms

Compromised accounts remain the responsibility of the account owner unless BrickHosting determines otherwise.

You must notify BrickHosting immediately if you believe your account, server, panel, billing profile, or credentials have been compromised.


6. Customer Data and Backups

You are solely responsible for maintaining backups of your data.

BrickHosting does not guarantee backups unless a specific paid backup service or written agreement states otherwise.

BrickHosting is not responsible for:

  • Deleted files
  • Corrupted data
  • Failed uploads
  • Failed backups
  • Service termination data loss
  • User error
  • Data loss caused by abuse, suspension, migration, failure, or third-party systems

BrickHosting may provide backup tools or storage, but availability of such tools does not guarantee successful recovery.


7. Acceptable Use Policy

You may not use BrickHosting services for illegal, abusive, harmful, deceptive, infringing, or high-risk activity.

Violations may result in:

  • Warning
  • Rate limiting
  • Service isolation
  • Service suspension
  • Data removal
  • Account restriction
  • Permanent termination
  • Refusal of future service
  • Legal or provider escalation

BrickHosting may act with or without notice when needed to protect infrastructure, customers, providers, legal compliance, or third parties.


8. Illegal Activity

The following are prohibited:

  • Violating applicable laws
  • Hosting illegal content
  • Fraud
  • Phishing
  • Impersonation
  • Identity theft
  • Unauthorized account access
  • Credential theft
  • Stolen data distribution
  • Carding
  • Financial fraud
  • Scam infrastructure
  • Law enforcement evasion
  • Court order evasion

BrickHosting may suspend or terminate services immediately for suspected illegal activity.


9. Network Abuse

The following are prohibited:

  • DDoS attacks
  • DDoS-for-hire infrastructure
  • Botnet activity
  • Malware command and control
  • Unauthorized port scanning
  • Unauthorized vulnerability scanning
  • Packet interception
  • Spoofing
  • IP reputation abuse
  • Spam infrastructure
  • Open proxy abuse
  • Open relay abuse
  • Brute-force attacks
  • Credential stuffing
  • Network harassment
  • Any activity that harms network stability or third parties

BrickHosting may null-route, firewall, throttle, isolate, suspend, or terminate services involved in network abuse.


10. Resource Abuse

Customers may not abuse shared or dedicated resources.

Prohibited activity includes:

  • Resource exhaustion
  • Excessive CPU abuse
  • Excessive disk I/O abuse
  • Excessive bandwidth abuse
  • Excessive database load
  • Unauthorized stress testing
  • Unauthorized benchmarking
  • Mining cryptocurrency without written approval
  • Large-scale scraping without written approval
  • AI abuse or automated workload abuse
  • Circumventing resource limits
  • Running workloads designed to degrade infrastructure

BrickHosting may apply limits to:

  • CPU
  • RAM
  • Storage
  • Bandwidth
  • Databases
  • Containers
  • Processes
  • Ports
  • Runtime allocation
  • Backups
  • Snapshots
  • API requests

11. Malware and Exploit Content

The following are prohibited:

  • Malware
  • Ransomware
  • Spyware
  • Trojans
  • Worms
  • Botnet software
  • Exploit kits
  • Credential stealers
  • Phishing kits
  • Malicious loaders
  • Malware droppers
  • Unauthorized remote access tools
  • Software designed primarily for compromise or abuse

Security research tools may only be hosted with written approval and must not be used against systems without authorization.


12. Harmful Content

The following are prohibited:

  • Child sexual abuse material
  • Sexual exploitation content
  • Terrorist content
  • Violent extremist content
  • Doxxing
  • Harassment campaigns
  • Threats of violence
  • Content used to coordinate harm
  • Non-consensual intimate content
  • Content that violates applicable law or provider policy

BrickHosting may remove or disable access to harmful content immediately.


13. Spam and Messaging Abuse

The following are prohibited:

  • Spam
  • Mass unsolicited email
  • SMS abuse
  • Discord spam
  • API spam
  • Webhook spam
  • Bot-driven harassment
  • Mailing list abuse
  • Notification abuse
  • Platform rate-limit evasion

BrickHosting may restrict outbound traffic, suspend services, or terminate accounts involved in messaging abuse.


14. VPN Usage Policy

VPN hosting must be used lawfully and in compliance with these Terms.

VPN services may not be used for:

  • Fraud
  • Spam
  • Phishing
  • Credential attacks
  • DDoS activity
  • Scraping abuse
  • Platform ban evasion
  • Illegal content access or distribution
  • Hiding illegal activity
  • Reselling VPN access without written approval
  • Activity that damages BrickHosting IP reputation

BrickHosting does not guarantee anonymity, privacy from legal process, or immunity from investigation.

BrickHosting may monitor VPN-related metadata for security, abuse prevention, billing, and infrastructure protection.

BrickHosting may suspend, restrict, or terminate VPN services without refund for abuse or suspected abuse.


15. Game Server Hosting

Game servers hosted through BrickHosting must comply with all applicable publisher, platform, marketplace, and community rules.

The following are prohibited:

  • Pirated servers
  • Cracked servers
  • Cheats
  • Exploits
  • License bypasses
  • Leaked paid assets
  • Unauthorized monetization
  • Copyright-infringing content
  • Stolen scripts
  • Backdoored resources
  • Malware-infected resources
  • Server files obtained from leaks or unauthorized redistribution

Customers are responsible for ensuring that all server files, assets, scripts, plugins, maps, textures, mods, and monetization systems are legally permitted.


16. FiveM, RedM, Rockstar, and Cfx.re Compliance

BrickHosting may provide FiveM-compatible or RedM-compatible hosting infrastructure.

BrickHosting is not approved, sponsored, endorsed, certified, affiliated with, or operated by Rockstar Games, Take-Two Interactive, FiveM, Cfx.re, or RedM.

Customers using BrickHosting services for FiveM, RedM, or other Rockstar Creator Services are solely responsible for compliance with:

  • Rockstar Games Terms of Service
  • Rockstar Creator Platform License Agreement
  • Rockstar Community Guidelines
  • Rockstar Roleplay Server Policy
  • FiveM and Cfx.re policies
  • Marketplace terms
  • Applicable laws and platform rules

The following are prohibited on BrickHosting services:

  • Leaked FiveM resources
  • Pirated scripts
  • Stolen assets
  • Unauthorized use of Rockstar-owned assets
  • Unauthorized monetization
  • Real-money cash-out systems
  • Gambling
  • Casino-style paid chance mechanics
  • Loot boxes
  • Gacha mechanics
  • Paid random rewards
  • Sale of in-game currency for real money
  • Crypto, NFTs, tokens, or blockchain-based server monetization
  • Third-party sponsorships or advertisements inside server content where prohibited
  • Any server content or monetization that violates Rockstar, FiveM, Cfx.re, or applicable platform rules

BrickHosting may suspend or terminate services that appear to violate Rockstar, FiveM, Cfx.re, or related platform policies.


17. Discord Bots and Platform Bots

Discord bots and other platform bots must comply with all applicable platform rules.

For Discord bots, customers must comply with:

  • Discord Terms of Service
  • Discord Developer Terms of Service
  • Discord Community Guidelines
  • Discord API rules
  • Discord rate limits
  • Any applicable bot verification or privileged intent requirements

Prohibited activity includes:

  • Spam bots
  • Scam bots
  • Phishing bots
  • Token logging
  • Credential harvesting
  • Self-bot abuse
  • API abuse
  • Rate-limit evasion
  • Malicious automation
  • Harassment automation

BrickHosting is not responsible for Discord account bans, bot bans, API restrictions, verification failures, platform enforcement, or loss of access.


18. Code and Application Hosting

You must have the legal right to deploy all software, code, packages, dependencies, and applications hosted through BrickHosting.

The following are prohibited:

  • Cracked software
  • License bypass tools
  • Key generators
  • Pirated applications
  • Stolen source code
  • Backdoored code
  • Malicious scripts
  • Illegal automation
  • Unauthorized API abuse
  • Software used primarily for fraud, phishing, malware, or compromise

Open-source software must be used in compliance with its applicable license.


19. Database Hosting

The following may not be stored or processed through BrickHosting services:

  • Stolen data
  • Breached databases
  • Credential dumps
  • Payment card data without authorization and required compliance
  • Illegal datasets
  • Doxxing databases
  • Data collected through unlawful scraping
  • Data used for fraud, spam, harassment, or credential attacks

Customers are solely responsible for database security, access control, encryption, compliance, backups, and lawful data processing.


20. Resale and White-Label Use

Customers may not resell, sublicense, lease, share, or white-label BrickHosting services without written approval.

Prohibited activity includes:

  • Reselling services without approval
  • Selling access to BrickHosting infrastructure as your own
  • Creating unauthorized hosting businesses on top of BrickHosting
  • Sharing one account across unrelated third parties
  • Using BrickHosting to bypass provider or platform restrictions

BrickHosting may approve reseller arrangements in writing at its discretion.


21. Payments and Billing

Services are billed according to the selected product, plan, billing cycle, invoice, or custom agreement.

Billing may include:

  • Monthly subscriptions
  • Yearly subscriptions
  • One-time services
  • Usage-based charges
  • Add-ons
  • Setup fees
  • Account balance payments
  • Custom services

Accepted payment methods may include supported third-party payment processors and approved manual methods.

BrickHosting may refuse, reverse, or require review of payments that appear fraudulent, suspicious, unauthorized, or high-risk.

Customers are responsible for keeping billing information accurate and ensuring invoices are paid on time.

Unpaid invoices may result in suspension, termination, or deletion of services.


22. Account Balance and Stored Funds

Customers may add funds to an account balance where supported.

Account balance:

  • Is not a bank account
  • Does not earn interest
  • Has no cash value outside BrickHosting
  • Is not transferable without approval
  • May only be used for eligible BrickHosting services
  • May be reviewed for fraud or abuse
  • May be withheld or forfeited in cases of fraud, chargeback, abuse, or Terms violations where allowed by law

BrickHosting may refuse balance refunds where funds have been used, credited as promotion, connected to abuse, or otherwise restricted under these Terms.


23. Subscriptions, Cancellations, and Renewals

Subscription services renew automatically unless canceled before renewal.

Customers are responsible for canceling unwanted services before renewal.

Cancellation stops future renewal but does not automatically create a refund.

Failure to use a service does not cancel billing.

BrickHosting may suspend or terminate unpaid services after invoice nonpayment.

Data may be deleted after cancellation, nonpayment, suspension, or termination.


24. Chargebacks and Payment Disputes

Chargebacks, payment reversals, unauthorized disputes, or payment fraud may result in:

  • Immediate service suspension
  • Account restriction
  • Permanent termination
  • Loss of account balance
  • Refusal of future service
  • Recovery of unpaid amounts
  • Submission of evidence to payment processors

Customers should contact BrickHosting at [email protected] before opening a payment dispute.


25. Refund Policy

Refunds may be requested within 48 hours of purchase unless otherwise stated.

All refunds are subject to review and approval.

Refunds may be denied for:

  • Used services
  • Suspended services
  • Terminated services
  • Abuse cases
  • Terms violations
  • Setup fees
  • Custom work
  • Dedicated resources
  • Dedicated IPs
  • Licenses
  • Domains
  • Third-party costs
  • Payment processor fees
  • Account balance already used
  • Promotional credits
  • Failure to cancel before renewal
  • Customer configuration errors
  • Server performance issues caused by customer workloads

BrickHosting may issue refunds to the original payment method, account balance, or another method at its discretion.

No refund is guaranteed unless required by applicable law.


26. Coupons, Promotions, and Credits

Coupons, promotions, vouchers, and credits are discretionary.

BrickHosting may modify, revoke, or refuse promotional offers at any time.

The following are prohibited:

  • Multi-account abuse
  • Voucher duplication
  • Coupon farming
  • Referral abuse
  • Fraudulent promotional use
  • Reselling promotional credits

Promotional credits have no cash value and may be removed for abuse or account termination.


27. Service Availability and Maintenance

BrickHosting does not guarantee uninterrupted service unless a written Service Level Agreement states otherwise.

Services may be affected by:

  • Maintenance
  • Hardware failure
  • Software failure
  • Network issues
  • DDoS attacks
  • Upstream provider outages
  • Power events
  • Security incidents
  • Misconfiguration
  • Customer workload behavior
  • Third-party platform changes
  • Emergency mitigation

BrickHosting may perform maintenance with or without notice.

No credit, refund, or compensation is owed for downtime unless a written SLA states otherwise.


28. Security and Abuse Investigation

BrickHosting may investigate suspected abuse, security threats, policy violations, or illegal activity.

BrickHosting may review:

  • Service metadata
  • Network activity
  • Runtime behavior
  • Resource usage
  • Process behavior
  • Deployed files
  • Logs
  • Panel activity
  • Billing activity
  • Account access history

BrickHosting does not review private files without reason, but privacy is not guaranteed during abuse, legal, security, or infrastructure investigations.

BrickHosting may preserve, disclose, or provide information where required by law, provider policy, valid legal process, or safety need.


29. Suspension and Termination

BrickHosting may suspend, restrict, or terminate services or accounts for:

  • Terms violations
  • Abuse reports
  • Nonpayment
  • Fraud risk
  • Chargebacks
  • Illegal activity
  • Security threats
  • Resource abuse
  • Platform policy violations
  • Third-party complaints
  • Provider requirements
  • Law enforcement requests
  • Risk to BrickHosting infrastructure or reputation

Suspension or termination may occur with or without notice.

Data may be deleted after suspension, termination, cancellation, nonpayment, or abuse enforcement.

BrickHosting may refuse future service to terminated users.


30. Intellectual Property

Customers retain ownership of their lawful content, applications, configurations, and uploaded materials.

BrickHosting retains ownership of:

  • Infrastructure systems
  • Internal tools
  • Automation systems
  • Panel configurations
  • Documentation created by BrickHosting
  • Branding
  • Website content
  • Service designs
  • Operational workflows

Customers may not copy, resell, scrape, reproduce, clone, or misuse BrickHosting systems, branding, documentation, or service configurations without written permission.


31. Copyright and DMCA

BrickHosting respects valid copyright claims.

Copyright notices should be sent to:

A valid copyright notice should include:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing material
  • The location of the material
  • Contact information
  • A good-faith statement
  • A statement made under penalty of perjury
  • A physical or electronic signature of the copyright owner or authorized agent

BrickHosting may remove, disable, suspend, or restrict allegedly infringing content upon valid notice.

BrickHosting may terminate repeat infringers.

Counter-notices may be submitted where legally permitted.

BrickHosting is not required to resolve private ownership disputes without valid legal process or sufficient documentation.


32. Law Enforcement and Legal Requests

BrickHosting may cooperate with law enforcement, courts, regulators, payment processors, upstream providers, and other lawful authorities.

BrickHosting may preserve or disclose account, billing, service, or network information when required or reasonably necessary to:

  • Comply with law
  • Respond to valid legal process
  • Protect infrastructure
  • Prevent abuse
  • Investigate fraud
  • Protect customers or third parties
  • Enforce these Terms

33. Third-Party Services

BrickHosting services may depend on third-party providers, software, APIs, panels, payment processors, networks, operating systems, libraries, or platforms.

BrickHosting is not responsible for:

  • Third-party outages
  • Account bans
  • API restrictions
  • Platform enforcement
  • Payment processor decisions
  • Software vulnerabilities
  • Licensing disputes
  • Marketplace removals
  • Changes to third-party services
  • Discontinuation of third-party projects
  • Customer failure to follow third-party rules

Customers are responsible for reviewing and complying with all third-party terms that apply to their use.


34. No Legal, Security, or Compliance Advice

BrickHosting may provide technical guidance, documentation, or support.

Such guidance is not legal, financial, compliance, tax, or security advice.

Customers are responsible for obtaining professional advice where needed.


35. Limitation of Liability

To the maximum extent permitted by law, BrickHosting is not liable for:

  • Lost revenue
  • Lost profits
  • Lost data
  • Downtime
  • Service interruption
  • Business interruption
  • Reputation damage
  • Indirect damages
  • Incidental damages
  • Consequential damages
  • Customer misuse
  • Third-party enforcement
  • Platform bans
  • Provider outages
  • Security incidents outside BrickHosting control

BrickHosting’s maximum liability is limited to the amount paid by the customer for the affected service during the 30 days before the event giving rise to the claim.


36. Indemnification

You agree to indemnify, defend, and hold harmless BrickHosting, its owners, operators, staff, contractors, partners, and providers from claims, damages, losses, liabilities, costs, and expenses, including legal fees, arising from:

  • Your content
  • Your applications
  • Your servers
  • Your users
  • Your billing activity
  • Your violation of these Terms
  • Your violation of law
  • Your violation of third-party rights
  • Your violation of platform policies
  • Your misuse of BrickHosting services

37. Changes to These Terms

BrickHosting may update these Terms at any time.

Updated Terms may be posted on BrickHosting.org, the billing portal, Discord, announcements, or customer notices.

Continued use of BrickHosting services after updates means you accept the updated Terms.

If you do not agree to updated Terms, you must stop using BrickHosting services.


38. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law rules.

Any dispute must be brought in courts located in New York, unless otherwise required by applicable law.
